The Zoning Board of Adjustment has the authority to grant use variances from the approved municipal zoning ordinances and approval of a site plan application for development in conjunction with such a variance. The Board can also hear appeals of certain decisions of the Zoning Officer and make determination of pre-existing, non-conforming uses.
Initial questions about applications may be directed to the Building and Zoning Office in the Municipal Building at 973-427-5555, ext. 214.
Application for property subdivisions and site plan review (where no use variances are required) must be submitted to and approved by the Planning Board.
Chapter 293, paragraph 293-14, of the Code of the Borough of Hawthorne establishes Hawthorne’s Zoning Board of Adjustment pursuant to NSJ.A. 40:55D-1 et seq. The Mayor, with the advice and consent of the Borough Council, appoints seven members to four-year overlapping terms, and two alternate members to two-year overlapping terms.
